1. Invitation

Mulualem Farm Enterprise would like to appoint a supplying & consulting firm that carry out design , manufacture , supply , erecting & commissioning of tomato processing plant.

Local bidders should buy detailed bid document  from branch office located at Addis Ababa , Gulele Sub City , Woreda 04 , Adane Gebeya Center , House no 884 & office number 10 by paying a non returnable 100 ETB  and

Financial offer should be submitted in a wax-sealed envelope marked offer for “OPEN TENDER NO. MUFA 001/2017 on or before August 03/2017 at specified address.  International bidders should also submit by similar ways using DHL addressing P.O.Box 10066 A.A or can directly submitted to mulualemtomato1@gmail.com before August 03/2017.

MUFE reserves the right to accept or reject the bid fully or partially.

2. INSTRUCTION TO BIDDERS

ELIGIBLE BIDDERS

This invitation for bid is open for all bidders that are qualified technically & technologically competent to design, manufacture, supply, erect & commissioning of tomato processing machines.

COST OF BIDDING

The bidder shall bear all costs associated with preparation & submission of its bid and Mulualem Farm Enterprise here in after referred to as "The Purchaser" will in no case be responsible or liable for those costs, regardless of the conduct or outcome of the bidding process.

Bidders shall examine the invitation to bid as well as all the attached TOR, instruction & bid requirements.

BID DOCUMENTS

Service required and bidding procedure is indicated in detail in the Bidding.

Documents the Bidding documents consist of:-

"   Seven    - Terms of reference (TOR)

Failure to furnish information required or submission of a bid not substantially responsive to the requirements of the Bidding documents will be at the Bidder risk and may result in the rejection of its bid.

5. If any Bidder needs further clarification relating to the Bid it should do so in writing at the purchasers mailing address. The purchaser will respond in writing to any request for clarification of the Bidding documents which it receive not later than 15 days prior to the deadline for the submission of Bids prescribed by the purchaser.    

6.AMENDMENT OF BID DOCUMENTS

6.1  At any time prior to the Deadline for submission of Bids, the purchaser may, for any reason, whether at its own initiative or in response to a clarification requested by a prospective Bidder, modify the Bidding documents by amendment.

6.2 The amendment will be notified in writing to all prospective bidders which have received the Bidding documents and will be binding on them.

6.3 In order to afford prospective bidder’s reasonable time in which to take the amendment in to account in preparing the bids, the purchaser may, at its discretion, extend the deadline for the submission of bids.

7.  LANGUAGE OF BIDS.

The bid prepared by the bidder & all correspondences and documents related to the Bid exchange by the bidder & the purchaser shall be written in English language.

8. DOCUMENTS COMPRISING THE BID

The bid submitted by the bidder shall comprise the followings:-

8.2. Financial offer detail form furnished in the Bidding document.

8.3. Documentary evidence that the bidder is eligible to bid, is qualified to perform the contract if the bid is accepted,

9. BID PRICES

9.1. The bidder shall indicate the total bid price of the service it proposes to offer under the contract; all taxes & related costs shall be included in the total price with out exception.

The bidder shall not change the bid price after opening of the tender.

The price should be valid for 60(sixty) working days from the date of financial offer opening.

10. BID CURRENCIES

Price shall be quoted for the service within Ethiopia in Birr or from outside Ethiopia in any convertible currency.

FORMAT AND SIGNING OF BID

The Bidder shall prepare:-

Bidders are required to submit two (2) copies of technical proposal and  single copy of financial proposal to “ Mulualem Farm Enterprise”

Financial offer one original of the documents comprising the Bid clearly marked “Original” in addition the Bidder shall submit one copy of the documents comprising the Bid clearly marked “Copy”.  In the event of any discrepancy between them the original shall govern.

The original & copy of the Bid shall be typed and shall be signed by the bidder or person duly authorized to sign on behalf of the bidder.

SUBMISSION OF BIDS

The Bidder shall seal in wax the original & copy of the Bid in separate envelopes duly marking the envelope as “Offer for Open Tender No MUFE001/17 Original” and “offer for open tender no MUFE001/17  Copy ” The envelopes shall then be sealed in an outer envelope. If not sealed & marked the purchaser will assume non responsibility for the Bids misplacement or premature opening.

The inner & outer envelopes shall be Addressed to the purchaser at the following address:-

The Bidder shall give the sealed envelope in person or send it by registered mail. It is Bidders responsibility to determine the manner by which timely delivery of his Bid will be accomplished.    

DEADLINE OF SUBMISSION OF BIDS.

Bids must be received by the purchaser at the address specified above before August 03/2017

EXTENSION OF SUBMISSION DATE

The purchaser shall extend the offer submission date with its own intention or upon request of bidder and which has acceptance by the purchaser. However, the bidder should raise extension request prior to 15(fifteen) days of the submission date. If the submission date is extended, the purchaser shall announce the extension on the same media that the tender was announced.  

LATE BIDS

Any Bid received by the purchaser after the deadline for submission of Bids prescribed by the purchaser, pursuant to clause 13 will be rejected and/or returned unopened to bidder.

APPOINTMENT OF AN AGENT

Any bid submitted by person other than the consultant or supplier shall accompany by an authorized certified Agency form the consultant or supplier stating that the Bidder is an authorized agent of the said manufacturer or supplier.

The appointment of an agent shall make before the submission of the bid and the certificate of agency shall reach MuFE before or with the bid.

Authorized agent must submit a copy of their business license currently renewed.

CLOSING OF BIDS BY THE PURCHASER

17.1 The Bids will be closed on August 03/2017

17.2 The Bidder names, Bid prices, modifications and presence or absence of the required bid bond and any such other details, which the purchaser may consider appropriate, will be announced.

CLARIFICATION OF BIDS

The purchase may, at its desecration ask any bidder for clarification of its bid if it helps in the examination, evaluation & comparison of bids. The request for clarification and the response shall be in writing or by cable and no change in the price of substance of the Bid shall be sought, offered or permitted.

PRELIMINARY EVALUATION

The purchaser will examine the bids to determine whether they are complete, any computational errors have been made, whether the required securities have been submitted, the documents have been improperly signed and also the bids are generally in order.

EVALUATION AND COMPARISON OF BIDS

After the public opening of Bids, information relating to the examination, clarification, evaluation & comparison of Bids & recommendation for award of contract shall not be disclosed to Bidders or any other persons not officially concerned with such process until the award to successful bidders has been announced.

Any effort by a bidder to influence the purchaser in the purchaser's bid evaluation, Bid comparison or contract award decisions may result in the rejection of the bidder's bid.

The evaluation will be carried out in two stages. In the first stage the proposals will be evaluated on technical basis, which comprise 60% and in the second stage, the offers of technically competent suppliers will be evaluated on financial basis, which consist 40 % of the total point.

BID EVALUATION

Only candidates that fulfill the minimum requirement given in section 4 of  and fully covered the scope  of  the service described  in TOR shall be evaluated from 100%.

Technical offer shall be evaluated by Technical Committee. After evaluation the technical offer shall be separated as “accepted” and “not accepted”. The “accepted” offer shall directly pass to financial evaluation and not accepted shall be out of evaluation.

THE FINANCIAL EVALUATION PARAMETERS ARE:

All suppliers who scores not less than 80% the point scored by the highest bidder in the technical evaluation should be short listed for the financial evaluation.

NOTIFICATION OF AWARD

The purchaser will notify the successful bidder in writing by facsimile or continent media.

The notification of award will constitute the formation of the contract.

Upon successful Bidders furnishing of performance security. The purchaser will promptly notify each unsuccessful bidder and will discharge its bid security.

DELIVERY OF THE SERVICE

Bidders must indicate the commencement time in the appropriate space on the Bid Form and Price Schedule.

PERFORMANCE BOND

Within 10 days after the bidder's receipt of notification of award, the successful bidder   shall furnish performance bond in the amount of 10% of the total value.

The performance bond shall not have any additional conditions.

The performance bond shall be denominated in a freely convertible currency acceptable to the purchaser and shall be in the form of

Bank guarantee

A cashier's payment order

The performance bond shall be sent to the purchaser in advance of signing of the contract & shall have effect on the date it is received by the purchaser or on the date the contract is signed.

Failure of the successful bidder to comply with the requirement of 2.1 shall constitute sufficient ground of the announcement of the award & forfeiture of the bid bond in which event the purchaser may make the award to next lowest evaluated bidder or call for new bids.

SIGNING CONTRACT

After award notification the successful bidder shall sign and date the contract and return to the purchaser the contract document within 15 days after award notification.

DISQUALIFICATION OF BID.

Bidders who do not satisfy any one of the conditions could be disqualified.
